Agreement to Terms

By accessing or using the services provided by PRO Estimating ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access our services.

Services Description

PRO Estimating provides construction cost estimating, material takeoff, bidding assistance, and related consulting services. Our estimates are professional opinions based on the information provided and current market conditions at the time of preparation.

Accuracy Disclaimer

While we strive for accuracy in all our estimates, construction cost estimates are inherently projections based on available information. Actual construction costs may vary due to:

  • Market fluctuations in material and labour prices
  • Unforeseen site conditions
  • Design changes or scope modifications
  • Regional variations in construction practices
  • Contractor-specific overhead and profit requirements

Our estimates should be used as a professional guide for budgeting and bidding purposes, not as a guaranteed fixed price for construction.

Client Responsibilities

To receive accurate estimates, clients must:

  • Provide complete and accurate construction documents (blueprints, specifications)
  • Communicate project requirements, scope, and special conditions clearly
  • Notify us of any changes to the project scope or specifications
  • Review estimates promptly and provide feedback within the agreed timeframe

Payment Terms

Payment terms are specified in the service agreement or invoice provided at the time of engagement. Standard terms include:

  • Standard project estimates: payment due upon delivery
  • Monthly plans: payment due at the beginning of each billing cycle
  • Custom projects: payment schedule as agreed in the project proposal

Confidentiality

We treat all client project information, including blueprints, specifications, and cost data, as confidential. We will not disclose your project details to third parties without your consent, except as required by law.

Intellectual Property

Upon full payment, clients receive the right to use deliverables (estimates, takeoffs, reports) for their intended business purpose. PRO Estimating retains ownership of proprietary estimating methodologies, databases, and templates.

Limitation of Liability

PRO Estimating's liability for any claim arising from our services shall not exceed the fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages resulting from the use of our estimates.

Termination

Either party may terminate the service agreement with written notice. Upon termination:

  • Payment is due for all work completed through the termination date
  • Client retains rights to deliverables for which payment has been made
  • Monthly plan subscribers may cancel with 30 days' notice

Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated to active clients via email. Continued use of our services after changes constitutes acceptance of the updated terms.
